HARROP WARRANTY POLICY
This Warranty is given by Harrop Engineering Australia Pty Ltd ACN 134 196 080 (Harrop) of 96 Bell Street, Preston Victoria 3072. Telephone: +61 3 9474 0900. Email: [email protected]
This document sets out the warranty terms and conditions for the Products ("Warranty"). Please also refer to the current Terms and Conditions of Sale document and any other product specific warranty document supplied with the Product.
- Definitions
- In this Warranty:
- 1.1 Ancillary Parts means the non-Harrop manufactured serviceable parts integral to the operation of the Product, including but not limited to bearings, pulleys, clamps, wiring looms, hoses, drive belts, injectors, switches and other consumable items;
- 1.2 Customer means the original purchaser or end user of the Product if purchased through an Authorised Dealer;
- 1.3 HPC means Harrop Performance Centre and its employees;
- 1.4 Product means all goods provided by Harrop to the Customer, but broken down into sub categories as listed in the Product Warranty Scope;
- 1.5 Supercharger means all sizes of Harrop TVS Superchargers, whether in kit format with Ancillary Parts or as a head unit only, installed in the Vehicle and having the serial number set out in the Confirmation of Harrop Warranty or other warranty document issued to the original Customer on purchase of the Supercharger;
- 1.6 Third Party Product means any non-Harrop manufactured Product, including Ancillary Parts, supplied to the Customer and having its own manufacturer’s warranty;
- 1.7 Warranty Period means the period of the warranty set out in Table 1 for individual Products, starting from the date of purchase and ending when either time period or miles travelled occur;
- 1.8 Workshop means a Harrop Authorised Dealer or a licensed automotive workshop with suitably qualified mechanics, approved by Harrop to supply and/or fit the Product;
- 1.9 Vehicle means the vehicle that the Product is fitted to.
- Product Warranty Scope
- 2.1 Harrop warrants in favour of the Customer that the Product will be free from manufacturing defects in materials and workmanship, under normal conditions of use and service, for the duration of the Warranty Period described below:

- 2.2 This Warranty will not apply where:
- 2.2.1 there is any defect in materials, components or workmanship in the installation of the Product by the Workshop; or
- 2.2.2 there is any defect in materials, components or workmanship in the Vehicle (excluding the Product); or
- 2.2.3 the Product failure is caused by consequential damages arising from, but not limited to incorrect engine calibration, incorrect fuel quality and/or octane rating or any other OEM or aftermarket part fitted to the Vehicle; or
- 2.2.4 in the specific case of Superchargers; the Supercharger is modified or used in any form outside Harrop’s specifications including but not limited to:
- i. excessive boost pressure or exceeding the maximum rotational speed of the Supercharger as outlined by Harrop, or
- ii. use after fitment of other non-Harrop products or accessories, including but not limited to drive pulleys, toothed Gilmer Drives, water/methanol injection and/or air conditioning based chiller systems; or
- iii. stop adjustment or manual movement of the factory pre-set bypass valve; or
- iv. use of coolant in the Intercooler system that does not comply to Ford WSS-M97B44-D or GMW3420 specification or has been mixed less than 50% concentrate with distilled or deionised water
- 2.2.5 in the specific case of ELockers; if the ELocker is engaged during any form of wheel rotation and/or crash locking occurs due to incorrect engagement;
- which causes or contributes to the defect in or damage to the Product.
- 2.3 This Warranty does not apply to fair wear and tear of the Product (being the gradual and normal reduction in performance and/or operation having regard to age and usage) or to any normal or routine maintenance, calibrations, alignments and other adjustments which may be required during the Warranty Period.
- 2.4 This Warranty will not apply where:
- 2.4.1 the Customer does not purchase the Product directly from Harrop or an authorised Workshop; or
- 2.4.2 the Product has not been registered via the online Warranty link at www.harrop.com.au, in accordance with the Confirmation of Harrop Warranty or other warranty documentation supplied with the Product and strictly within 14 days of purchase by the Customer; or
- 2.4.3 the serial number or any other production markings on the Product is tampered with or removed; or
- 2.4.4 the Product is altered or modified before, during or after installation; or
- 2.4.5 the Product is used in a manner contrary to Harrop’s recommendations for its design; or
- 2.4.6 the Product is incorrect for the Vehicle or intended application by the Customer.
- 2.5 If within the Warranty Period a defect in the materials or workmanship in or damage to the Product is discovered, Harrop will, at Harrop’s discretion, repair or replace the defective parts at its cost in accordance with this Warranty. If defective parts are repaired or replaced under this Warranty, the repaired or replacement parts will be covered by this Warranty only for the remainder of the Warranty Period.
- 2.6 With respect to Product installations and repairs performed through Harrop’s own workshop, Harrop offers a 12 month warranty on workmanship performed. However, the Customer warrants that their vehicle is registered, roadworthy and in suitable condition for any loads, speeds or temperatures that would be imposed, or may arise, during such testing which may include testing on a chassis dynamometer or on road. Harrop will not be responsible for any damages, including consequential damages, that may occur as a result of failure to comply to this.
- 2.7 Engineering advancements, changes in design or performance improvements of the Product does not constitute a reason for warranty return or replacement.
- 2.8 No employee of Harrop or a Harrop Authorised Dealer or other agent of Harrop has authority to vary the terms of this Warranty.
- 2.9 This warranty is not transferrable to subsequent owners.
- Customer Responsibilities and Limitations on Warranty
- The Customer is responsible for the proper handling and installation of the Product and for the proper use, service, maintenance and repair of the Vehicle the Product is fitted to. This Warranty will not apply if:
- 3.1 before installation the Product is stored or handled in any way contrary to Harrop’s instructions or specifications or is otherwise improperly stored or handled;
- 3.2 the Product is modified or used in any form outside Harrop’s specifications, which can be obtained from Harrop;
- 3.3 the Product is modified or used in conjunction with other non-Harrop products or accessories;
- 3.4 the Product is used after any defect in the Product or the Vehicle the Product is fitted to becomes apparent or would have become apparent to a reasonably prudent operator or user;
- 3.5 the Vehicle is subject to abuse or a driving style that the Vehicle manufacturer’s warranty would not cover;
- 3.6 the Vehicle is not properly serviced in accordance with the Vehicle manufacturer’s instructions and specifications relating to a vehicle driven under severe or ‘special operating conditions’ including circumstances of higher engine loading;
- 3.7 lubricants or coolants other than those recommended or approved by the manufacturer of the Vehicle and/or Harrop are used in the Vehicle or are used otherwise than in accordance with the Vehicle manufacturer’s instructions or specifications;
- 3.8 the Vehicle is stored, handled, maintained or repaired in any way contrary to the manufacturer’s instructions or specifications;
- 3.9 the Vehicle is handled, maintained or repaired in any way contrary to Harrop’s instructions or specifications;
- 3.10 the Vehicle is exposed to any abnormal climate conditions or operating circumstances;
- 3.11 the Vehicle is subjected to misuse, neglect, accidental or deliberate damage or destruction, or act of God;
- 3.12 the Vehicle is used in stunt activities or motorsports (including rallying, circuit racing, drag racing or any other competitive driving, practising or testing for the same);
- 3.13 the installation of the Product causes or contributes to the failure of the Vehicle to meet any Government or Regulatory standards including, but not limited to, ADR Emissions, CARB Certification or noise levels.
- Claiming Under Warranty
- 4.1 In order to make a claim under this Warranty, the Customer must strictly within 14 days of becoming aware of the apparent defect contact Harrop (see clause 6 below) to obtain a Warranty Claim Form and to be notified of a location for Harrop, a Harrop Authorised Dealer or other Workshop nominated by Harrop to which the Product should be delivered by the Customer.
- 4.2 The Product must be delivered to the location notified by Harrop strictly within 14 days together with a properly completed Warranty Claim Form.
- 4.3 Harrop will not accept any warranty claims made otherwise than strictly in accordance with this Warranty.
- 4.4 If the Product is found to be working satisfactorily, the Customer must pay all reasonable costs of testing the Product before the Product will be released to the Customer.
- 4.5 The Customer will be responsible for all costs of delivering the Product to the location notified by Harrop and for collection of the Product from such location including all costs of removal and refitting of the Product from the Vehicle and any other expenses of the Customer in claiming under this Warranty.
- 4.6 Harrop’s determination as to the existence of any defect or the cause of any defect is conclusive.
- 4.7 Any parts which are replaced under this Warranty become the property of Harrop.
- Harrop’s Responsibilities on Claims Under Warranty
- 5.1 Harrop will within a reasonable period after delivery of the Product under clause 4.2:
- 5.1.1 assess the Customer’s warranty claim and determine whether Harrop accepts the claim; and
- 5.1.2 notify the Customer whether it accepts the Customer’s warranty claim.
- 5.2 Harrop will at its discretion carry out or arrange the repair or replacement of the defective parts with new or refurbished parts or the replacement of the defective parts with alternative parts with the same or similar specifications. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.
- 5.3 Harrop will ensure that all repairs and replacements under clause 5.2 are carried out:
- 5.3.1 within a reasonable time after the Customer is notified of the acceptance of the Customer’s warranty claim; and
- 5.3.2 by an appropriately qualified motor mechanic or technician.
- 5.4 Harrop will liaise with the Customer and the person carrying out the relevant repairs or replacements and ensure that the Customer is fully informed as to the progress and nature of the repairs and replacements carried out.
- 5.5 Harrop will be responsible for the cost of repairing or replacing the defective parts (only) as described under this clause and the Customer will not be issued any invoice for such costs.
- 5.6 Harrop will not be responsible for:
- 5.6.1 any cost relating to the warranty repair, including but not limited to, cost to diagnosis product, product removal or product reinstallation once repaired;
- 5.6.2 any transport or ancillary costs, including but not limited to, towing, rental car, accommodation or Customer relocation costs;
- 5.6.3 any loss of profits or other indirect or consequential loss whatsoever arising from any defect;
- 5.6.4 any indirect or consequential loss or damage to the Vehicle, including any damage to mechanical, electrical or body components of the Vehicle, arising from any defect;
- 5.6.5 any loss or damage to the Product or Vehicle occurring whilst the Product or Vehicle is in transit (i.e either on delivery to or collection from the location notified by Harrop);
- 5.6.6 any loss or damage caused by any delay in assessing the Customer’s claim or in repairing or replacing defective parts.
- 5.1 Harrop will within a reasonable period after delivery of the Product under clause 4.2:

- Application of Consumer Laws
- 7.1 The benefits of this Warranty are in addition to any other rights and remedies available to the Customer under the law.
- 7.2 Nothing in this Warranty is intended to have the effect of contracting out of any applicable provision of the Australian Consumer Law, except to the extent permitted by those Acts.
- 7.3 The Australian Consumer Law requires the inclusion of the following statement in any warranty in respect of goods supplied to a consumer as defined under the Australian Consumer Law:
“Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service”
